These Terms of Service ("Terms") form a legally binding agreement between you and Polldium ("we", "us", "our") governing your use of the Polldium platform at polldium.com (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EU) to use Polldium. By using the Service you confirm that you meet this requirement and that you are not prohibited from using it under the laws of your jurisdiction.

2. Your Account

• You are responsible for maintaining the security of your account credentials. Do not share your password.
• You must provide accurate information when creating your account.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@polldium.com if you suspect unauthorised access to your account.
• You may only hold one account. Creating multiple accounts to circumvent restrictions is prohibited.

3. Acceptable Use

You agree not to:

• Post polls, comments, or any content that is unlawful, hateful, threatening, harassing, defamatory, obscene, or discriminatory.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Post spam, unsolicited promotions, or artificially inflate vote counts through automation or coordinated inauthentic behaviour.
• Attempt to access, scrape, or interfere with any part of the Service in a way not permitted by these Terms.
• Upload malware, viruses, or any code designed to harm or disrupt systems.
• Use the Service to collect personal data from other users without their consent.
• Circumvent, disable, or interfere with security features of the Service.

4. Poll Content Standards

Polls and associated content must comply with our Acceptable Use policy above. We reserve the right to hide, remove, or restrict any poll that violates these Terms without prior notice. Repeated violations may result in account suspension or termination.

Predictive polls are opinion-based forecasting exercises and do not constitute financial advice, gambling, or securities activity. The points system has no real-world monetary value and cannot be exchanged for cash or goods.

5. The Points System

• Points are a virtual currency within Polldium. They have no monetary value and cannot be withdrawn, transferred outside the platform, or exchanged for real-world currency or goods.
• Points earned or lost through predictive polls reflect forecasting accuracy only.
• We reserve the right to adjust, reset, or remove points at any time, including in the case of abuse or technical error.

6. Your Content

You retain ownership of content you post on Polldium (polls, comments, profile information). By posting content you grant us a worldwide, non-exclusive, royalty-free licence to display, store, and distribute that content as necessary to operate the Service. This licence ends when you delete the content or your account, subject to the retention periods described in our Privacy Policy.

You represent that you own or have the rights to any content you post, and that your content does not infringe any third-party intellectual property rights.

7. Our Intellectual Property

All software, design, trademarks, and other intellectual property comprising the Polldium platform belong to us or our licensors. These Terms do not grant you any right to use our name, logo, or branding without prior written consent.

8. Suspension and Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in behaviour harmful to other users or the platform, or for any other reason at our reasonable discretion. We will endeavour to notify you via email unless doing so would compromise security or an ongoing investigation.

You may delete your account at any time from Settings. Upon deletion, your personal data is removed in accordance with our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Predictive poll outcomes and point calculations are provided for entertainment and forecasting purposes only and do not constitute financial, legal, or professional advice.

10. Limitation of Liability

To the maximum extent permitted by law, Polldium shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of points, or loss of profits, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) £100.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence provide otherwise.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
